FIFA Ultimate Team packs are not gambling: Netherlands Court

-

FIFA players love to open Ultimate Team packs that provide them player cards, sometimes you get lucky and sometimes not. Finally, the highest Dutch court ruled that FUT packs are no longer gambling in the Netherlands.

Previously in 2020, the Court of The Hague ruled that opening FUT packs come under gambling and also ordered Electronic Arts to remove those packs from FIFA. Moreover, the Hague court added that €500,000 will be added as a fine for every week they didn’t comply.

Now finally the highest court of the Netherlands has ruled that buying and opening FIFA Ultimate Team packs don’t come as an isolated game and those packs are a part of a game of skill.

As EA explains, the packs in FUT mode perform a multipurpose function. They simulate the uncertainty that also occurs in the real football world when putting together a team. The vast majority of packs are obtained by and used for game participation. The tradability of the packs on the black market is relative. The black market mainly focuses on trading complete accounts rather than individual packs or their contents.

Therefore, EA has received the green light to start selling FIFA Ultimate Team packs in the Netherlands. In addition, EA doesn’t have to pay the fine as per the court rule.

This decision confirms our belief that no aspect of FIFA or FIFA Ultimate Team can be considered gambling under Dutch law. At Electronic Arts our approach to game design puts choice, fun, fairness, and value first. Our priority has always been to make sure that our players in the Netherlands and across the world have a positive experience.
